Legal Custody vs. Physical Custody in New York

New York custody law recognizes two distinct types of custody, and understanding the difference matters before you enter any proceeding.

Legal custody
Legal custody governs the right to make major decisions about your child’s upbringing: education, health care, and religious observance. It can be awarded solely to one parent or jointly to both. Joint legal custody requires both parents to participate in those decisions together.

Physical custody
Physical custody, also called residential custody, determines where the child primarily lives. Like legal custody, it can be sole or joint. Joint physical custody means the child spends roughly equal time with each parent, though New York has no statutory presumption of a 50/50 split. Depending on the severity and pattern of the violations, remedies may include make-up parenting time, modification of the existing arrangement, or a contempt finding for willful non-compliance.
